Terms of Sale

These terms cover books bought directly from Simms and Farrell Publishing Limited (“S&F Publishing”, “we”, “us”) through simmsandfarrellpublishing.com. They sit alongside our privacy policy, which explains what we do with your information. Please read them before you order — by placing an order you agree to them.
Where a book on this site links out to another shop, you are buying from that shop and their terms apply, not ours.
These terms are written for people buying as consumers, which is almost certainly you. If you are buying for a business, talk to us first — the cancellation rights below are consumer rights and do not apply to a trade order.

The registered office is our address for formal and legal correspondence. For anything to do with an order — a question, a return, a problem — please use the contact page, which reaches us far faster.
Prices and VAT
All prices are in pounds sterling and include everything except delivery, which is shown separately in your basket before you pay.
We are not registered for VAT. No VAT is added at checkout and none is charged on anything you buy from us, so the price on the page is the price you pay. For the same reason we cannot issue a VAT invoice. Printed books are zero-rated for VAT in the UK in any case, so this makes no difference to what a book costs you.
We may change our prices at any time, but a change never affects an order you have already placed. If a price is obviously wrong — a book listed at a fraction of what it plainly costs — we may cancel the order and refund you in full rather than fulfil it. We will always tell you, and we will never quietly charge you a different amount from the one you agreed to.
Placing an order
You add books to a basket and place the order through our checkout. Your order is an offer to buy, and a contract between us comes into being when we confirm your order by email — not before. If we cannot accept your order, we will tell you and you will not be charged.
The checkout re-checks every book in your basket at the moment you pay. If a title has sold out in the meantime, the checkout stops and tells you which one before any payment is taken. Very occasionally a book sells out between your payment and our packing it; if that happens we will contact you and refund that book in full.
We deliver to addresses in the United Kingdom only, so the checkout accepts UK addresses only. We sell printed books here; where a title is also available as an ebook, that is sold by the retailers listed on the book’s page and not by us.
Payment
Payments are taken by Stripe, our payment processor. Your card details are entered on Stripe’s own secure checkout and are held by Stripe — we never receive or store your card number. We are told only that a payment succeeded, along with the order details you gave us. Payment is taken when you place the order.
Delivery
Delivery times are estimates, not guarantees. If something has not arrived when you expected it, tell us and we will chase it. We send books to the address you give us at checkout, and they become your responsibility once they have been delivered there.
Changing your mind
You can change your mind about a direct order and send the books back for a refund. You do not have to give a reason, and this is on top of your rights if something is wrong with them.
The length of this window is set in our shop settings and shown here when the page can reach them. Ask us and we will confirm it — it is never less than the statutory minimum.
How to tell us
Any clear statement that you are cancelling will do. The quickest way is our contact page, or email contact@simmsandfarrellpublishing.com. You can also write to us at 128 City Road, London, EC1V 2NX, United Kingdom, though the post is slower and we would rather hear from you sooner. If you like, you can use the form at the end of this page, but you do not have to. Quote your order number if you have it — it makes everything faster.
Your cancellation counts from the moment you send it, not the moment we read it, so a message sent on the last day of the window is in time.
Sending the books back
Send them back to us within 14 days of telling us you are cancelling. You pay the cost of returning them. Please get a proof of postage — until the books reach us they are your responsibility, and proof of postage is what protects you if a parcel goes astray.
You are welcome to look through a book as you would in a bookshop. If it comes back damaged or used beyond that, we may reduce your refund to reflect the loss in value.
Your refund
We refund you within 14 days of getting the books back, or of your showing us you have sent them, whichever comes first. It goes back to the card you paid with, and there is no restocking fee or handling charge of any kind.
If you cancel your whole order we also refund the delivery you paid to receive it. If you keep part of the order and send the rest back, we refund the books you returned but not the delivery, since we still had to send you the parcel.
None of the usual exceptions to this right apply to us. We sell printed books, made to no one’s order and sealed in nothing, so there is no personalised item, no unsealed disc or download, and no perishable good in our shop that you could lose the right to return.
If something is wrong with your books
Everything we send must be as described, of satisfactory quality and fit for purpose. If it is not — the book arrives damaged, it is misprinted or bound wrongly, or it simply is not the title you ordered — you have rights that are entirely separate from changing your mind, and nothing in these terms takes them away.
Tell us within 30 days of receiving it and you can reject it outright for a full refund. After that we will repair or replace it, and if that is not possible or does not put it right, you can have some or all of your money back.
We pay the return postage on anything faulty, damaged or wrongly sent. Do not post it back at your own expense — tell us what has happened and we will sort out getting it back to us. A photograph usually saves everyone a lot of time.
Our responsibility to you
If we fail to comply with these terms we are responsible for loss or damage you suffer that is a foreseeable result of that failure. Loss or damage is foreseeable if it is obvious that it will happen, or if we both knew it might when you placed your order.
We do not exclude or limit our liability in any way where it would be unlawful to do so. That includes liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, for breach of your legal rights in relation to the books, and under the Consumer Protection Act 1987.
We supply books for private use. If you use them for any commercial purpose, we have no liability to you for loss of profit, loss of business, business interruption or loss of business opportunity.
We are not responsible for delays or failures caused by something outside our reasonable control. If one happens we will contact you as soon as we can, and if the delay is substantial you can cancel your order and we will refund anything you have paid for books we have not sent.
Your account
You can order without an account. If you create one, you are responsible for keeping your password to yourself. You can change your details, download a copy of your data or delete your account at any time from your account settings. Deleting your account removes your personal information but keeps a record of past orders in anonymised form, because we are required to retain sales records — see the privacy policy for exactly what that means.
Changes to these terms
We may change these terms from time to time. The version in force when you place an order is the one that applies to that order, so a later change can never alter a purchase you have already made. The date at the top of this page tells you when it last changed.
Complaints
If something has gone wrong, please tell us first — we are a small house and we would far rather fix it than have you left unhappy. We are not currently a member of an alternative dispute resolution scheme, so if we cannot settle a complaint between us you remain free to take the matter to court.
Other things worth knowing
This contract is between you and us, and nobody else has any right to enforce it. If a court decides any part of these terms is unlawful, the rest of them carry on in force. If we are slow to do something about a breach, that does not stop us doing something about it later.
These terms are governed by the law of England and Wales, and you can bring court proceedings in the courts of England and Wales. If you live in Scotland you may also bring proceedings in Scotland, and if you live in Northern Ireland, in Northern Ireland. Nothing here takes away any right you have under the law of the country you live in.
Model cancellation form
You do not need to use this — any clear statement that you are cancelling will do. It is here because we are required to make it available, and because some people would rather fill in a form than write a letter. Copy it, fill in the parts that apply and send it to us.
